Contract Guidelines

Contracts must define a specific period of performance and a cost associated with that period. Funding from an appropriate source must be available for the contract to be awarded.

The contractor’s SOW governs what the contractor will do on each task; contractors cannot be redirected to other tasks by the Technical POC. A modification to the statement of work is required if additional tasks or redirection is necessary. The modification to the contract must be in place prior to the “new” work being performed. Only the contracting officer can authorize modifications.

Other direct costs (supplies, materials and travel, for example) must be included in the contract if it is expected that the contractor will incur these costs when completing deliverables. If a requirement for other direct costs is generated during the period of performance, the contract must be modified to allow for the expenditure and funding must be provided prior to incurrence of the other direct costs.

A contract must be in place (awarded) prior to the commencement of work by the contractor. If work begins prior to the contract being awarded, the requestor has created an unauthorized commitment.

Contractors cannot continue to work if sufficient funding is not available on an existing contract. If work continues without funding, this would cause an unauthorized commitment.

The maximum period of performance on a single contract is normally 12 months. Contracts with option years are possible.

Contracts funded from sponsored project funds must provide direct support to the sponsored project.

Contracts with a period of performance beyond the expiration date of the funding source can be awarded if: 1) a bona fide need currently exists to award the contract at the time of the contract request. Contracts cannot be awarded with expiring funds to meet future needs; the need must be current. 2) the project funding the work continues for at least as long as the period of performance stated in the contract.

Contractors are not NPS employees; contractors can receive technical direction from NPS personnel but are not supervised by NPS personnel. Contractor employees will be under the control and supervision of management personnel of the contractor.

Contractors cannot be technical points of contact or acceptors of deliverables.

All individuals and companies desiring to do business with the government must complete Central Contractor Registration (CCR).
