EDUCATIONAL SKILL REQUIREMENTS (ESR)
The officer must understand the fundamental concepts and be familiar with the basic functional areas of labor law within the Department of the Navy (DON) and the Department of Defense (DOD), specifically with respect to:
1. Federal Labor Legislation, including:
- The Civil Service Reform Act
- The Civil Rights Act (Title VII)
- The Age Discrimination in Employment Act
- The Rehabilitation Act
- The Fair Labor Standards Act
- The Occupational Safety and Health Act
2. Federal administrative and adjudicative procedures including those of:
- The Office of Personnel Management (OPM)
- The Merit System Protection Board (MSPB)
- The Federal Labor Relations Authority (FLRA)
- The Federal Mediation and Conciliation Service (FMCS)
- The Equal Employment Opportunity Commission (EEOC)
- The Occupational Safety and Health Administration (OSHA)
The officer must be able to interpret and apply these laws/ regulations and court/administrative decisions to the DOD/ DON labor, employment, and occupational safety and health programs.
